My IP has been infringed

If you suspect that your IP rights have been infringed, this navigator tool (currently in pilot stage) is designed to provide clear and accessible information, giving you the confidence to take the next step.  

 

 

 

IP First Response asks up to 15 multiple choice questions about your rights, the suspected infringement, and your business situation. Based on your answers, it filters and organises over 30 potential options, highlighting those most likely to be relevant. 

IP First Response provides you with details about the considerations involved with the different pathways you could choose to pursue – but the decision on what best suits your situation remains yours. Please note that IP rights can be complex and nuanced, so there will not be one clear option, but several to consider and maybe even use in combination. 

This tool is not a substitute for professional advice (legal, business or other). IP Australia does not and cannot provide specific legal advice.

What questions you can expect 

You will not be asked to provide any personal or business information through this tool. 

You are not required to answer every question, but each answer helps improves the likelihood that the information is more relevant to someone in your situation.  

Before beginning, it can be helpful to confirm some details you will be asked about. 

1. Confirm your IP details, such as whether you have registered rights. 

2. Check if the suspected infringing party owns any IP relevant to this dispute.
